  16. $500,000.00 Settlement - Car Accident - to a 50 year-old man who, while driving home from work, was struck by a speeding, out-of-control car. Premises Liability / Negligence Injuries



  1. $3.5 million settlement paid to the family of a man who drowned in a public swimming pool which lifeguards failed to observe, notice or react to.
  2. $200,000.00 settlement paid to a young woman who fell at a party due to a hidden, unmarked and dangerous condition by the swimming pool at the premises, causing her to sustain serious facial, dental and scarring injuries.
  3. $750,000.00 Settlement - Slip & fall case - (Settled during litigation in Danbury, CT) - This is one of the largest slip and fall settlements on record in Connecticut. Plaintiff, a 33 year-old woman represented by Attorney Harvey Kulawitz slipped and fell on ice on her way to work at a large corporate park. She severely fractured her left leg and developed complications including Compartment Syndrome and Reflex Sympathetic Dystrophy (RSD). Several defendants were brought into the case, including the negligent snow plower; the property management company and insurance agencies who failed to write adequate coverage. Attorney Harvey J. Kulawitz established that his client was unable to return to work and lost her career at a large corporation as a result.
  4. $230,000.00 Settlement (Husband) + $80,000.00 Settlement (Wife) - Slip & Fall case - To a Connecticut couple, husband and wife, each 65 years old, who slipped and fell down a darkened stairwell at their country club. The husband fell first and his wife fell directly behind him when the exit stairwell at the club was left unlit, causing the husband to suffer left leg injuries and the wife to suffer right ankle injuries. Negligence case handled by Attorney Harvey J. Kulawitz on their behalf.

  5. $110,000.00 Settlement - Slip & Fall - to a 41 year old Ridgefield, CT man who slipped on ice outside his apartment complex and broke his leg. Attorney Harvey J. Kulawitz sued the apartment complex and the snow plower for negligent maintenance of the property where hundreds of people lived in rental apartments. The case was settled in litigation filed in Danbury, CT after Attorney Kulawitz proved through discovery and depositions that the property manager and the snow plower were unclear as to each other's maintenance duties for sidewalk snow and ice removal.

  6. $823,000.00 Settlement - Diving Accident - to a 23 year-old man who was at a church outing at a private pay-to-swim club. Two docks at the pond prohibited diving. The third did not. Plaintiff dove in from the third dock and struck his head on a submerged object jarring his spinal cord and rendering his body numb. Friends helped him from the water. He subsequently made a good recovery. Represented by Attorney Harvey J. Kulawitz a structured payment stream was recovered for plaintiff to be paid to him over several years for the club's negligence in allowing diving in an unsafe area.

  7. $210,000.00 Settlement - Slip & Fall Accident - to a 45 year-old woman who slipped and fell while leaving a restaurant vestibule area that was dimly lit with a "step down" that was not readily visible, causing her to fall and injure both of her ankles. Represented by Attorney Harvey J. Kulawitz, it was established that the landing did not meet building code requirements as well as being inadequately lit.


Wrongful Death Claims


  1. $1 million settlement paid to the family of a woman who was struck and killed by a speeding motorcyclist.
  2. $512,000.00 Wrongful Death Settlement - Elderly Woman Struck by Car & Killed - An elderly 85 year-old woman who was struck and killed by a car in Bristol, CT; Estate represented by Attorney Harvey J. Kulawitz in its wrongful death claim against the at-fault driver. This is one of the largest reported settlements on record in Connecticut for an 85 year-old decedent.
  3. $250,000.00 settlement paid to an elderly woman who sustained multiple trauma and injuries when she was struck on the golf course by an out-of-control golf cart.


Dog Bites


  1. $935,000.00 Settlement - Dog Bite - to a 3 year-old who was bit by his neighbor's bullmastiff. The dog got loose from its owner's property, dug under the fence and attacked the boy who was in his backyard with his father. The dog locked its jaw onto the boy's face and head causing him multiple injuries. The boy's father pulled the dog off and was also attacked but fortunately was not injured. The dog was subsequently put down. It had no prior history of aggressive behavior. The boy was represented by Attorney Harvey J. Kulawitz who negotiated a settlement with the dog owner's homeowner's insurance company for the available POLICY LIMIT - with an additional contribution coming from the dog owners themselves. The boy will be paid in a stream of tax-free payments over several years commencing with his 18th birthday. This is one of the largest dog bite settlements on record in Connecticut.


Food Poisoning 


  1. $150,000.00 Settlement - Food poisoning case - Plaintiff (a 56 year-old woman) represented by Attorney Harvey J. Kulawitz, contracted food poisoning while at a catered party in Sherman, CT. Later that evening she became seriously ill, vomiting and dizzy with loss of consciousness. She collapsed, cracking her teeth and fracturing her wrist when she fell. Attorney Harvey J. Kulawitz, recovered $150,000.00 for her from the catering company after proving that she contracted the food poisoning from contaminated food prepared by them.
  2. $90,000.00 settlement paid to a young woman who contracted E-Coli 0157 food poisoning at her employer’s cafeteria, requiring her to be hospitalized for same.


Life Insurance Policy Issues


  1. $628,547.00 Settlement - Life Insurance Policy - paid to the Estate of a man who failed to pay his policy premiums, so his life insurance company refused to pay the death benefit upon his death. However, representing the man's Estate against the insurance company, Attorney Harvey J. Kulawitz asserted that the policy contained a waiver of premium clause for nonpayment of premiums that applied to situations where the insured is "totally disabled" while the policy is in effect. Through medical experts Attorney Kulawitz established that prior to his death the Insured had lung cancer with metastatic brain involvement and remote effects syndrome, causing him memory lapses, out-of-character temper outbursts, missed crucial business appointments and indignant denials of same, a condition which rapidly deteriorated to dementia while the waiver of premium provision was in effect. Further Attorney Kulawitz charged the life insurance with having this information in its file but failing to disclose same, evidence of bad faith on its part, ultimately resulting in the company paying the entire policy, plus interest, to the man's Estate.


Firearm Injuries


  1. $226,000.00 Settlement - Firearm Accident - (Settled during litigation in Danbury, CT) - Awarded to a girl, who, when 16 years old, was accidentally shot in the eye by a BB gun. A lawsuit was commenced against the 15 year old shooter of the gun and against his parents for negligent supervision and failure to instruct the boy in the proper care and handling of a potentially dangerous weapon. The shooting resulted in the girl developing a traumatic cataract in her right eye, for which she underwent 2 surgeries, including implantation of an intraocular lens. Fortunately, she did not lose her sight and had an excellent recovery. Settlement was negotiated by Attorney Harvey J. Kulawitz with a Structured Settlement so that the girl will receive a stream of substantial payments, tax-free to her that she can use towards college, graduate school and beyond.
